Terms and Conditions

Requirements of Use

All customers that wish to use Diamano and our affiliated websites including Diamano Cash for Gold Market (cashforgoldmarket.com) and Diamano Fine Jewelry (diamano.com) must be at least 21 years of age in order to sell jewelry and precious metals and/or purchase products.  These customers must also agree that they are the legal owners of all gold and jewelry attempting to be sold and not acting as a representative or on behalf of another party. If required, Diamano shall be able to request documented proof of these requirements but shall not be obligated.  In submitting your goods to Diamano you are legally bound by all these and the following terms and conditions.

 

Guaranty Against Loss

In the event that properly shipped merchandise, in accordance with our instructions, sent to Diamano is lost, Diamano will retain no liability to any customer, therefore packages should be insured with postal carrier. Diamano also reserves the right to refuse delivery of any mail or parcel that appears the be damaged, opened, or tampered with and in this event the mail or parcel will be returned to the customer directly by postal service. 

 

Limitation of Liability

Diamano shall never be liable for any third party, including postal carriers, insurance carriers, and any other individuals relating to or attempting claim on the customer's transaction with Diamano.  Diamano's liability is specifically limited to the least of these three sums: 1/3 the appraised value submitted by the customer to Diamano at the time goods are received, the cash for gold liquidation value placed on total amount of goods by Diamano at Diamano's discretion, or the total sum of $100.00.  The customer agrees that in no case shall Diamano's liability exceed the one hundred dollars. If you believe your merchandise is worth more than one hundred dollars, we recommend that you insure your shipment for more at your own expense.

 

Verbal Offers

You may receive a quote from Diamano by telephone or e-mail at your request after Diamano has received and processed your items.  Upon acceptance of quote, whether written or oral, you are legally bound to the transaction and payment will be issued by Diamano within 24 hours and you will have no opportunity to return this payment and receive your items back.

 

Gold Spot Charts Disclaimer of Liability

Under no event is Diamano responsible for any data appearing on gold charts used in website. These charts are created by third parties and Diamano has provided these charts to educate customers and provide general information. Diamano is not liable to anyone for anyway in which this information is used.

 

Return Insurance Liabilities

In the event that the customer decides to cancel transaction and requests that merchandise is to be returned, Diamano will choose the return carrier, insurance amount, and receipt verification method.  Diamano will insure the package to be shipped at the quoted offer for said merchandise regardless of what the package was first insured for when mailed to Diamano. The customer agrees to wait until proper insurance recovery is resolved by the carrier. Once Diamano receives reimbursement a check for the exact amount quoted will be mailed out to customer within a twenty four hour period.

 

Acceptance of Terms

The customer agrees to accept all the terms and conditions explicitly stated in this list and on Diamano's website (cashforgoldmarket.com) by requesting mailing kit and initiating transaction. The acceptance of these terms and processing by Diamano of your transaction is further confirmed on endorsement of check as payment distributed by Diamano to customer. Endorsement of check will act as signature confirmation that the customer assumes full legal responsibility of items sold to Diamano. All checks must be deposited by first party. All third party endorsements will void the payment process.

 

Choice of Law, Waiver, and Claims

These terms and conditions and all transactions through Diamano (cashforgoldmarket.com) will be governed by the laws of the State of California without regard to its conflict of law provisions.  Diamano's failure to enforce any portion of this Agreement will not be considered a waiver of that portion. If any part of this agreement is found by a court of competent jurisdiction to be invalid, the parties will still agree to favor the provisions and intentions of this agreement in full force and effect. Regardless of any law, you agree that you have at maximum one year to file any claim from action caused by services offered by Diamano. Any such claim must be filed within the State of California.  Diamano shall be entitled to reimbursement for any legal costs including attorney’s fees or otherwise incurred in defending against any claim or civil action filed against Diamano Cash for Gold Market or any of our affiliated websites in any state outside of California.
